PRODUCTION NOTICE
This exact version was approved for production and made effective on August 1, 2026 by Jaime E. Fuentes II under TT-LGL-000P, TT-LGL-000Q, and TT-LGL-000R. These Terms are the active production baseline for the Platform, but they bind a user or organization only when presented through an applicable released acceptance method or otherwise made enforceable under applicable law. Any provider, configuration, feature, price, data-flow, retention, or workflow fact identified as conditional, implementation-pending, not yet selected, or not yet enabled is not represented as active and will be updated when the relevant information becomes available. Restricted or unreleased features remain excluded.

Agreement and Scope

These Platform Terms govern access to and use of the TruckerTech websites, applications, approved identity and access services, Core workflows, communications, Career functions, informational Ecosystem Partner experiences, approved connected integrations, orchestration features, and related services that are actually released and linked to these Terms (collectively, the “Platform”). A planned, preview, disabled, restricted, or separately contracted capability is not included merely because it is described elsewhere. Binding acceptance requires the approved affirmative acceptance design and retained exact-version evidence.

Eligibility and Authority

A user must be at least 16 years old and legally permitted to use the applicable service. Users aged 16 or 17 may participate only through an invitation or authorization from a verified organization that certifies the user’s lawful employment or engagement, authority, supervision, and any legally required parent or guardian permission. Users under 18 may not independently purchase paid services, complete identity-document, biometric, liveness, consumer-report, or other age-restricted workflows, or perform regulated freight activities unless applicable law and the relevant organization expressly permit them. Driver and CDL-related functions remain subject to all applicable licensing, employment, intrastate, interstate, and hazardous-work age requirements. A person acting for an organization represents that the person has authority to bind it. TruckerTech may require identity, age, role, authority, organization, insurance, licensing, employment, or other verification.

Accounts, TTID, and Federated Access

Each person must use an authorized account and protect authentication credentials. TruckerTech may issue or associate a TruckerTech identifier (“TTID”) and may support single sign-on or federated identity. Account access may not be sold, transferred, impersonated, or shared except through approved delegation. TruckerTech may suspend access when credentials, identity, authority, or activity present a security, fraud, compliance, or operational risk.

Role Organizations and Permissions

Platform rights depend on a user’s role, organizational relationship, assigned permissions, and the context of a Core or other workflow. Organizations are responsible for configuring access, maintaining authorized personnel, and removing access promptly. TruckerTech does not independently guarantee that every organization, user, credential, document, or transaction is legitimate.

Cores, Evidence, and Workflow Records

A Core is a governed digital workflow and evidence container associated with freight activity or another authorized transaction. Platform records may reflect invitations, acceptances, permissions, documents, statuses, signatures, attestations, communications, identity-assurance results, connected-system events, and audit evidence. Records may support operational trust but do not replace legal, regulatory, safety, insurance, licensing, contractual, or professional diligence required of participants.

Free Participation and Role-Specific Automation

Foundational participation is free for all supported role types. Each Role Organization may separately subscribe to its role-specific Automation capabilities. Automation primarily orchestrates authorized data and actions across that organization’s connected Ecosystem Partners, including governed external writes and related workflows where released and permitted. Ordinary manual participation does not create paid usage. Any subscription or usage charge requires affirmative authorization, a disclosed plan and price, attributable organization-specific evidence, applicable provider terms, invoice and tax treatment, cancellation and dispute procedures, and implemented billing controls. Partner Services remain separately disclosed, attributable, and authorized unless an executed agreement expressly includes them.

Identity Assurance and Live Acceptance

Identity-document, biometric, face-comparison, liveness, and Live Acceptance functions are not included in the base launch and must remain disabled. No user is required or permitted through these Terms to provide biometric or liveness material. Any later activation requires a separately selected and approved provider, purpose-specific notice and consent, jurisdiction and age controls, retention and deletion rules, tested security and audit controls, an explicit Founder activation decision, and a separately released Identity Verification, Biometric and Liveness Notice and Consent.

Connected Services and Ecosystem Partners

Users may authorize approved connections to third-party systems and Ecosystem Partners. Those services are governed by their own terms and privacy practices. TruckerTech may transmit, receive, transform, reconcile, or initiate only the data and actions permitted by the user’s and organization’s granted scopes, server-side authorization, applicable Core permissions, and the provider-specific approval record. Connected-mailbox write, send, delete, and legally significant autonomous actions remain disabled unless separately approved and tested. TruckerTech is not responsible for a third party’s independent availability, decisions, or conduct except as required by law or an express written agreement.

User Content and Customer Data

Users and customers retain their rights in identifiable content and Customer Data they lawfully provide. They grant TruckerTech the limited rights reasonably necessary to host, process, transmit, secure, support, and provide the authorized Platform services. TruckerTech owns the Platform, software, interfaces, workflows, documentation, operational metadata, and intelligence that is independently developed or aggregated or de-identified so that it is not reasonably linkable to an identifiable person or customer, subject to applicable law, contract, and the Privacy Notice. TruckerTech does not acquire ownership of identifiable Customer Data merely because it is processed through the Platform.

Acceptable Use

Users must comply with the TruckerTech Acceptable Use Policy. Prohibited conduct includes fraud, impersonation, unauthorized surveillance, credential abuse, unlawful discrimination, harassment, malicious code, interference, scraping outside authorized interfaces, misuse of identity or location data, and attempts to bypass permissions, security, billing, or audit controls.

Electronic Communications and Signatures

Electronic records, notices, signatures, acceptances, and communications are governed by the Electronic Communications and E-Sign Consent when it is presented and affirmatively accepted. A user must maintain current contact information and the hardware and software described in that consent.

Privacy and Security

The Privacy Notice and applicable feature-specific notices describe verified data practices. TruckerTech may state only safeguards that are implemented and evidence-backed. No certification, penetration-test result, uptime level, immutable-log claim, encryption scope, monitoring coverage, backup capability, or incident-response timing is promised unless the exact claim is verified and approved. No system is perfectly secure. Users must promptly report suspected compromise and cooperate with protective measures.

Suspension and Termination

TruckerTech may limit, suspend, or terminate access for violations, nonpayment, risk, legal requirements, security incidents, misuse, or threats to participants or the Platform. Where practicable, TruckerTech may provide notice and an opportunity to cure. Provisions that by nature should survive will survive termination, including payment obligations, intellectual-property protections, disclaimers, liability limits, dispute terms, and evidence-retention rights.

Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. TRUCKERTECH DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SUFFICIENT TO PREVENT ALL FRAUD, LOSS, DELAY, SAFETY EVENTS, OR DISPUTES. TRUCKERTECH IS NOT A MOTOR CARRIER, BROKER, FREIGHT FORWARDER, EMPLOYER, INSURER, LAW ENFORCEMENT AGENCY, CONSUMER REPORTING AGENCY, OR PROFESSIONAL ADVISER SOLELY BY PROVIDING THE PLATFORM.

Limitation of Liability

To the maximum extent permitted by law, TruckerTech and its affiliates, personnel, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, goodwill, data, or business opportunity. Unless a signed agreement states a different cap, TruckerTech’s aggregate direct liability arising from paid services will not exceed the fees paid or payable for the affected services during the 12 months before the event giving rise to the claim; for free services, the aggregate direct-liability cap is USD 100. These limitations do not apply to payment obligations, fraud or willful misconduct, or liability that cannot lawfully be limited.

Indemnification

Business users and organizations will defend and indemnify TruckerTech against third-party claims arising from their unlawful content, misuse, material violations, lack of authority, or employment or contracting decisions, to the extent permitted by law and subject to TruckerTech’s control of the defense, reasonable cooperation, and consent to settlement. This business indemnity does not apply to an individual acting solely in a personal or household capacity.

Governing Law and Disputes

These Terms are governed by Georgia law, except where applicable law requires otherwise. Before initiating formal proceedings, the parties must attempt in good faith to resolve the dispute through written notice and at least 30 days of informal resolution. When the separately disclosed arbitration and opt-out process is operational and presented at acceptance, individual disputes will be resolved by binding individual arbitration under the applicable rules identified in that process, with a 30-day right to opt out after first acceptance, an exception for eligible small-claims matters, and the right to seek temporary or emergency equitable relief. To the maximum extent permitted by law, covered disputes proceed only on an individual basis. Business and organization disputes not subject to an applicable arbitration agreement will be brought in the state courts located in Glynn County, Georgia, or the United States District Court for the Southern District of Georgia, Brunswick Division. Until the arbitration opt-out workflow is operational and disclosed at acceptance, this section does not itself activate mandatory arbitration.

Changes

TruckerTech may update these Terms. Material changes will be communicated as required by law and will apply prospectively from the stated effective date. Continued use after effectiveness constitutes acceptance where permitted.
